Terms and conditions
- Template: replace the highlighted parts before publishing and have the texts reviewed by a lawyer. The German version is authoritative.
1. Scope
These terms apply to all contracts between Company name (“provider”) and its customers for the use of Kamvara. The offer is directed exclusively at businesses within the meaning of § 14 BGB. Deviating terms of the customer only apply if the provider expressly agrees to them.
2. Services
Kamvara is web-based, modular software for organising a business, e.g. planning, team, absences, customers, contracts, payroll preparation and communication. The scope depends on the plan booked. Notes and checks in the software are aids and do not replace legal, tax or payroll advice.
3. Trial
New accounts can use Kamvara free of charge with all features for 14 days. The trial ends automatically and does not turn into a paid plan. Afterwards the data is kept and can be viewed and exported until a plan is booked or the account is deleted.
4. Prices and payment
The prices shown at booking apply, plus statutory VAT. Depending on the chosen billing cycle, fees are payable monthly or yearly in advance and collected by payment method. Upgrades take effect immediately, downgrades at the start of the next month.
5. Term and cancellation
The contract runs for an indefinite period and can be cancelled by either party at any time with effect from the end of the current month. The right to terminate for good cause remains unaffected. The customer can export their data until the contract ends.
6. Customer obligations
The customer keeps their login details secret, only gives access to authorised persons and ensures that they may lawfully process the data entered – in particular that of their employees.
7. Availability
The provider makes Kamvara available with a monthly average availability of e.g. 99%. Announced maintenance and disruptions beyond the provider’s control are excluded.
8. Data protection and processing
Where the provider processes personal data on behalf of the customer, the parties conclude a data processing agreement pursuant to Art. 28 GDPR. Details are set out in the privacy policy.
9. Liability
The provider is liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slightly negligent breaches of essential contractual obligations, liability is limited to the typical, foreseeable damage; otherwise it is excluded.
10. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is city. If a provision is invalid, the rest of the contract remains valid.
